Terms of Service

Acceptance

By installing or using WHO-SEE-MY-PHONE (WSMP), an app published by OWESI STUDIO of Lahore, Pakistan, you agree to these Terms of Service. If you do not agree, do not use the app.

Eligibility

You must be at least 18 years old, or the age of legal majority in your country, to use this app. If you are under that age, you may not install or use it. By using the app you confirm that you meet this requirement and that you have the legal authority to agree to these terms.

Permitted use

The app is intended to help you monitor access attempts on devices you own or are authorized to monitor. You are responsible for using the app lawfully and for complying with local laws relating to surveillance, recording, consent, employment, privacy, and device monitoring.

Prohibited use

You must not use the app to monitor a device you do not own or lack clear authority to monitor. You must not use it for unlawful spying, stalking, harassment, intimidation, deception, or to capture images of a person in circumstances where they have a reasonable expectation of privacy.

You must not attempt to reverse engineer, decompile, modify, resell, or redistribute the app, or use it to breach the security of any device or account. Violating this section terminates your right to use the app immediately.

Licence and intellectual property

OWESI STUDIO grants you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the app on devices you control, for your own non-commercial use. All rights not expressly granted are reserved.

The app, its name, logo, design, and source code remain the property of OWESI STUDIO and its licensors. This licence does not transfer any ownership to you. Content you capture with the app, such as incident photos, remains yours.

Permissions and device features

The app may request permissions or privileged access, including camera access, notifications, foreground service, Device Admin, boot handling, biometric options, and network access where applicable. Some features will not work unless you choose to grant the required access.

Ads and third-party services

The app may use third-party services such as Google Mobile Ads, Google Play services, Google sign-in, and Google Drive. Your use of those services may also be subject to the terms and policies of those providers. Where required, the app will ask for your advertising consent before serving personalized ads.

Cloud services

If you enable Google Drive sync, you authorize the app to upload incident data to your own Google Drive account. You are responsible for your Google account, your Drive content, and any retention or deletion choices made there.

Your responsibilities

You are responsible for securing your device, reviewing captured content, deciding how long to keep that content, and ensuring that your use of the app does not violate the rights of others.

No guarantee

The app is provided as a tool to assist with device monitoring. The developer does not guarantee that every unauthorized access attempt will be detected, that every photo will be captured, that cloud sync will always succeed, or that the app will be uninterrupted or error-free on every Android device or OS version.

Data loss and backups

You are responsible for backing up any content you want to keep. The developer is not responsible for loss of incident data, photos, settings, ads state, sign-in state, or cloud content caused by device changes, uninstallation, OS restrictions, account issues, connectivity problems, or user actions.

App availability and updates

Features may change, be improved, or be removed over time. The app may also be updated to address bugs, compatibility issues, security needs, policy requirements, or legal requirements.

Limitation of liability

To the maximum extent allowed by law, the app is provided on an “as is” and “as available” basis, without warranties of any kind. The developer is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the app.

Where liability cannot be excluded, the developer's total liability to you is limited to the greater of the amount you paid for the app in the twelve months before the claim, or USD 10. Nothing in these terms limits liability for death, personal injury, fraud, or any other liability that cannot lawfully be excluded.

Indemnity

You agree to indemnify and hold harmless OWESI STUDIO from any claim, demand, loss, or expense, including reasonable legal fees, arising out of your misuse of the app, your breach of these terms, or your violation of any law or of the rights of a third party — including any use of the app to monitor a device or person without proper authority.

Termination

You may stop using the app at any time by disabling features, revoking permissions, clearing data, disconnecting cloud sync, or uninstalling the app. The developer may change, suspend, or discontinue the app or parts of the service at any time, and may terminate your licence immediately if you breach these terms.

Governing law and jurisdiction

These terms are governed by the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-law rules. The courts of Lahore, Pakistan have exclusive jurisdiction over any dispute arising from these terms or your use of the app.

If you are a consumer resident in the European Union or the United Kingdom, this clause does not deprive you of the protection of the mandatory consumer laws of your country of residence, nor of the right to bring proceedings in your local courts.

Severability

If any provision of these terms is held to be invalid, unlawful, or unenforceable, that provision will be severed or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Changes to these terms

These terms may be updated when app features, service providers, or legal requirements change. When a material change is made, the effective date above will be updated and, where required, you will be notified in the app. Continuing to use the app after a change means you accept the revised terms. If you do not accept them, uninstall the app.

Entire agreement

These terms, together with the Privacy Policy, form the entire agreement between you and OWESI STUDIO regarding the app, and supersede any prior understanding on that subject.
